A Day in the Life…Dora Castro – Domestic Abuse Paralegal

As a woman that grew up in Latin America, I soon came to release that in a world of ‘macho’ culture my opportunities were going to be limited. I grew up in a country where women were punished simply for being women.  Gender based violence was a common topic within our national legal affairs and I grew up thinking that the only way to help people suffering from domestic violence would be through the rule of law. As soon as I arrived in England, I studied English and shortly after I studied law. I wanted to help vulnerable people as a professional priority.

I joined National Legal Service as legal assistant in January 2019 and nine months later I was promoted to the position of a fee earning paralegal, with casework responsibility.

Part of my role is applying for injunctions for people who need protection from domestic abuse, it is this work that led to me being contacted by LAWRS (Latin American Women’s Right Service) a ‘human rights organisation focused on addressing the practical and strategic needs of Latin American migrant women displaced by poverty and violence’. The first case I was referred was that of a Latin American woman who did not speak English, she had been attacked by her partner. After establishing her situation, I explained that I would be able to help her with a non-molestation order through legal aid. That same day I took her statement in Spanish.

I was appalled by the horrific acts of violence that her partner had committed against her. The violence started as comments of criticism, then escalated in to worsening acts of physical violence, culminating in a horrendous violent act that had a profound impact on her mental health.

A non-molestation order is an order that protects a person from what can be constant ill-treatment of an abuser.  This order has the magnificent virtue of being able to be issued as an emergency order, and if deemed necessary it can take only a few hours for a Judge to grant the order. In this case, she received the protection of the non-molestation order on the same day that we sent her documents to the Court.

When preparing her statement, and given the extent of what she was alleging, there had been no doubt in my mind that she would be granted the order. My client had never experienced violence from a partner before and she could not understand how she could have let it happen to her. I felt that it was part of my job to reassure her it was not her fault and that once the order was granted, she would be able to get her life back.

My client wanted to feel safe and legally protected,  if the non-molestation order was breached, her partner could go to prison for up to 5 years, be fined (or both). After the Judge granted the non-molestation order, my client felt a huge sense of relief and gratitude that she could go out without panicking and she could continue with her life.

My client told me was delighted that she had managed to speak to a paralegal in her own language; someone who understood her cultural background; a paralegal who understood her needs in her native language.  My client wanted to have a party and celebrate the fact that she could be herself again and focus on her family.

Thankfully, my client’s non-molestation order was not contested by her partner therefore, I applied to the Court to make her order final; meaning she was protected by its terms for 12 months.

I personally believe that women who live in a different country and do not speak the language are in a very vulnerable position.  It is a vulnerability that can be abused. Having then to encounter legal terms and explanations by a legal professional in a different language, where the legal system is different, can be terrifying.

I think it must be horrific to live in an unknown land, where you are being abused by a person who should be taking care of you, with no friends or family for support, and above all, where you do not know your rights. My client was completely unaware of her right to apply for an injunction for her protection.  Protection that will now give her the peace and freedom most of us take for granted every day.

I continue to help Latina American women in England.  For me, being in the position of helping vulnerable people who need urgent help is a great responsibility. I can speak to them in their native tongue without the hassle of an interpreter and I hope to continue to do this for the rest of my professional life.

Un día en la vida de un asistente legal de abuso doméstico

Como una mujer que creció en América Latina, me dí cuenta de que en un país “machista” mis oportunidades eran limitadas. Creci en un país donde las mujeres son castigadas por el hecho de ser mujeres. Las noticias diarias sobre la violencia de género erá un tema común en mi país. Crecí pensando que la única forma de ayudar a personas vulnerables sería a través del estado de derecho. Tan pronto como llegué a Inglaterra estudié inglés y poco después estudié derecho. Quería ayudar a todas aquellas personas vulnerables como una prioridad profesional.

Comencé a trabajar para la oficina de abogados de National Legal Service Solicitors en Enero de 2019 como administradora y nueve meses después me ascendieron como asistente legal (paralegal). Tan pronto como logré preparer papeles legales para la Corte, me contactó LAWRS (Latin American Women’s Right Service), una “organización de derechos humanos centrada en abordar las necesidades prácticas y estratégicas de las mujeres migrantes Latinoamericanas desplazadas por la pobreza y la violencia”. Cuando me refirieron a mi primer caso de una mujer Latinoamericana que no hablaba Inglés y fue atacada por su pareja, inmediatamente la contacté y le pregunté sobre su situación.

Le expliqué que podría ayudarla con una orden de no abuso (Non- Molestation Order) mediante asistencia legal (Legal Aid). Después de que mi cliente me enviara todas las pruebas necesarias, solicité Asistencia Legal (Legal Aid) y ese mismo día tomé su declaración en Español. Me horrorizaron los actos de violencia que la pareja cometió contra mi cliente. La violencia comenzó como un simple comentario de crítica, luego pasó de un pequeño acto de violencia física a un horrible acto violento que tuvo un impacto profundo en la salud mental de mi cliente.

Una Orden de Non-Molestaion es una orden que protege a una persona de los constantes malos tratos por parte del abusador, esta orden tiene la magnífica virtud de ser emitida como una orden de emergencia, podría tomar horas o un par de días para que un Juez otorgue la orden.

Después de mandar todos los documentos correspondientes a la Corte, mi cliente tuvo que esperar un par de horas para que un Juez otorgará una orden de no acoso. Mi cliente nunca antes había experimentado violencia por parte de su pareja y no podía entender cómo ella permitió que eso sucediera. Por lo tanto, era mi trabajo asegurarle que una vez que se le otorgara la Orden, ella podría recuperar su vida.

Mi cliente quería sentirse segura y protegida legalmente por una orden que, si se incumplía, su pareja podía ir a prisión por hasta 5 años. Después de que el Juez otorgó la orden de no abuso, mi cliente se sintió más que feliz, fue una sensación de alivio y gratitud. Sintió que podía salir a la calle sin pánico y podía continuar con su vida. Mi cliente estaba encantada porque logró hablar con una asistente legal que hablaba su propio idioma y entendía su origen cultural, un asistente legal que podía entender sus necesidades en su idioma. Mi cliente quería celebrar el hecho de que se le permitió volver a ser ella misma y concentrarse en su familia. La orden de no abuso de mi cliente no fue impugnada por su pareja, por lo tanto, solicité al Tribunal que la orden fuera definitive, esto le daría a ella  12 meses de protección. Un año donde ella se sentirá libre.

Creo firmemente que las mujeres que viven en un país extranjero donde no hablan el idioma del país, están en una posición muy vulnerable. Una vulnerabilidad de la que se puede abusar. Sumandole la terminologia legal y explicaciones por parte de un profesional del derecho en otro país, con un idioma diferente, donde el sistema legal es diferente, puede ser aterrador.

Debe ser dificil vivir en un lugar donde estás siendo abusado por una persona que debería estar cuidando de ti, en un lugar totalmente ajeno y, sobre todo, en un lugar donde se desconoce los derechos. Mi cliente desconocía por completo su derecho a solicitar una orden judicial para su protección. Protección que le dará una sensación de paz y libertad invaluable.

Después de que mi cliente recibió su orden judicial, logré continuar con mi trabajo de ayudar a más mujeres Latinoamericanas en Inglaterra. Para mí estar en la posición de ayudar a las personas más vulnerables es una gran responsabilidad y desearía poder hacerlo por el resto de mi vida profesional.
