The law in the UK states that it is illegal to carry a firearm, knife or even a baseball bat in certain circumstances. These offences are taken incredibly seriously and often carry a prison sentence.


What is classified as offensive weapons?

The short answer is; almost anything. Anything ‘made or adapted’ for the purposes of an offence can be considered an offensive weapon.

Is it an offence to carry an imitation firearm?

Yes. Depending on the ‘type’ of weapon, these offences can carry a mandatory minimum sentence of 5 years imprisonment.

What is the maximum sentence for possession of a firearm?

Depending on the charge that the prosecution chooses to select, the maximum penalty can include life imprisonment.

What is the maximum sentence for possession of an offensive weapon?

6 months for an offensive weapon and 12 months for possession of a bladed article. If you are caught with a bladed article, two times in the same three years the Court will consider automatically giving you a minimum sentence of 6 months. This is very difficult to avoid, although our solicitors have a long-established reputation of encouraging the Court to consider the individual defendant and often avoiding a custodial sentence as a result.

R v JW

Our client, a 13-year-old boy was caught with an ‘imitation firearm’. This was a toy gun that he and some friends had been playing with. Unfortunately, our client was considered a suspect and was arrested and detained.

Following our advice and assistance at the police station and representations to the police, they realised that this was not a ‘criminal’ matter and chose to take no further action against our client.

R v JP

Our client, a troubled youth was caught with a knife for the third time in 2 years. He was sentenced for this, and numerous other offences. The expert case preparation and representation at Court ensured that he did not receive a custodial sentence, in spite of the law that two knife offences should automatically result in a 6-month sentence.

R v DG

Our client, a 17-year-old boy who struggled to engage with our solicitors at Court. Despite the difficulties in engaging with this our client was the victim of a violent assault himself, and on attending hospital for treatment, was caught with a knife. At NLS we understand that people often feel that they have to carry a knife for protection. Although this is not a defence to the allegation, we always act to ensure that the Court understands why non-violent individuals may feel compelled to carry a knife.

R v MS

Our client, a 15-year-old girl dropped a knife at her brothers' school. Carrying a knife onto primary school premises would be a seriously aggravated version of the offence. Our client, who made a simple mistake in accidentally picking up a kitchen knife when collecting her schoolwork did not realise how serious the offence could be and did not have a solicitor at her interview. We acted to obtain the details about the interview and wrote a letter of representations to the CPS to ensure that the case did not go any further.
