National Legal Service Helps Abused Mother And Her Children Get Protection From Violent Father

Last year we were instructed by Eliza* (not her real name).

Eliza had been in a relationship with her ex-partner for 9 years, they had two children together.

During their relationship Eliza was physically and emotionally abused.

The team were initially instructed by Eliza to apply for a non-molestation order to protect her from her ex which was granted for 6 months by the court.

A few days after the hearing, Eliza’s ex attended her home and repeatedly banged on the door for the children, Eliza was scared that he would try to remove the children from her care.

The team quickly made an application for a prohibited steps order along with a child arrangements live with order. During these proceeding the children revealed they too had been hit by their father which resulted in Eliza raising safeguarding concerns.

The prohibited steps order was granted by the court, the child arrangements proceedings are ongoing, we continue to support Eliza.

Although proceedings have not concluded Eliza feels much safer knowing she has the protection of the non-molestation order, she is also content knowing the children cannot be removed from her care.
