Legal Aid – Family Law Disputes and Care Proceedings
If you are a victim of domestic abuse, then subject to a means & merits assessment, you may be eligible for legal aid & we can help you with your application for protective orders. In addition, legal aid may also cover Children Act Proceedings which aids in securing and safeguarding your children (subject to evidence pursuant to Regs 33 or 24 of LASPO).
If social services are involved with your family, our dedicated care team headed by Sheena Donlon can help. We have a number of solicitors that are accredited by the Law Society and are on the children panel, in recognition of their expertise and skillset in this type of proceedings.
Early advice can be crucial when social services are involved. Legal Aid is available for parents if there are letters from social services confirming their intention to apply for children to be removed from the parents/ care giver. If you have been asked to attend a PLO meeting & you are a parent you will be entitled to legal aid and will be able to have representation at that meeting for free. If you are not a parent but are the main carer for the child, you may still be eligible for free legal advice and assistance under the legal help scheme.
If you are a mother or father (or carer with parental responsibility) in respect of proposed court proceedings ie. Care and supervision proceedings – you will be entitled to free legal advice to be represented in those court proceedings. Applications for Emergency Protection Orders and Child assessment orders will also see parents/ carers with parental responsibility eligible for free legal advice.
Applications for Secure Accommodation Orders
Discharge of care order, contact with a child in care, appeals against final care and supervision orders, placement orders, recovery orders and adoption – may see you eligible for legal aid depending on the outcomes of a means and merits test.
